Tallywire ("we") operates an environmental record proximity screening API. Each successful call returns matched federal and state environmental records within specified distance bands of a supplied address or coordinate, along with an explicit statement of what was and was not searched.
This service is screening data only. It is not a regulatory record search and does not satisfy — and is not intended to satisfy — ASTM E1527-21, the EPA All Appropriate Inquiries rule (40 CFR Part 312), or any state analogue. It is not a Phase I Environmental Site Assessment. Tallywire is not an Environmental Professional as defined in 40 CFR 312.10.
You must not rely on any response from this service for any regulatory, transactional, or liability-protection purpose. Interpretation of environmental records requires a qualified environmental professional. Ordering, or being party to a decision to order, this service does not substitute for that professional judgment.
Access is priced per successful call and settled via x402 (USDC on the Base network). Where the underlying x402 protocol requires a payment payload as a condition of receiving a response, your submission of a valid payment payload constitutes acceptance of these Terms.
Unsuccessful calls — HTTP 422 (insufficient geocode precision), 400 (malformed request), and 5xx (server error) — are never billed.
The service is provided "as is" and "as available", without warranty of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or the accuracy, completeness, or timeliness of any data returned.
To the maximum extent permitted by law, Tallywire's aggregate liability arising out of or relating to this service — whether in contract, tort, or any other theory — is limited to the fees you paid to Tallywire for the specific call giving rise to the claim. In no event will Tallywire be liable for lost profits or for consequential, incidental, punitive, or special damages.
The service draws on public environmental records including
datasets published by the Texas Commission on Environmental Quality
(TCEQ) and the U.S. Environmental Protection Agency (EPA).
Machine-readable attribution per source is returned in every
/v1/coverage response. Nothing in these Terms grants
you additional rights in the underlying source data beyond those the
publishing agency provides.
Tallywire may revise these Terms by publishing a new version at a distinct URL. Prior versions remain reachable, and calls made under them stay bound to the version they accepted. This is version 1.
